These Terms of Service (“Terms”) apply to your use of geekaudit.com (the “Site”) and the marketing audit, planning, management and team training services (the “Services”) provided by Geek Audit (“Geek Audit”, “we”, “us” or “our”). By using the Site or our Services, you agree to these Terms. If you do not agree, please do not use them.
1. Our Services
Geek Audit audits marketing, builds plans and roadmaps, manages marketing, and trains in-house teams. The exact scope, deliverables, timeline and fees for any project are set out in a written proposal, quote or agreement (a “Proposal”). If a Proposal conflicts with these Terms, the Proposal wins for that project.
2. Free Consultation
Your first or second consultation call is free. All other Services are paid and quoted based on your needs. A free call does not create any obligation for you or for us.
3. Quotes, Fees and Payment
- Prices are quote-based and confirmed in your Proposal.
- Unless the Proposal says otherwise, invoices are due on receipt.
- We may pause work on overdue accounts until payment is received.
- Fees do not include third-party costs such as ad spend, software subscriptions or paid tools, unless stated in the Proposal.
4. Your Responsibilities
- Give us accurate information and timely feedback.
- Provide access to the websites, accounts and tools we need, and make sure you have the right to grant that access.
- Make your team available for scheduled training sessions and assigned tasks.
- Delays in access, feedback or approvals may shift timelines.
5. Results
Marketing results depend on many factors outside our control, such as search engine and platform changes, competition, budgets and how recommendations are put into action. We give our honest expert advice, but we do not guarantee specific rankings, traffic, leads, sales or revenue.
6. Intellectual Property
- Site content: All text, graphics, logos and materials on the Site belong to Geek Audit or its licensors. You may not copy, resell or republish them without our written permission.
- Deliverables: Once paid in full, you may use the audits, reports, plans and other deliverables made for you within your business.
- Training materials: Training content, templates and frameworks remain our property. Your team may use them internally but may not resell, share publicly or use them to train others outside your company.
7. Confidentiality
We keep your business information, data and account access confidential and use it only to deliver the Services. We ask that you also keep our pricing, Proposals and training materials confidential.
8. Cancellation and Refunds
Cancellation and refund terms are set out in your Proposal. If none are stated, either side may end ongoing Services with 14 days’ written notice, and you pay for work completed up to the end date. Fees for work already delivered are not refundable.
9. Acceptable Use of the Site
You agree not to misuse the Site, including sending spam through our forms, trying to access systems without permission, scraping content, or uploading harmful code.
10. Third Party Tools and Links
The Site and Services may involve third-party platforms and links. We are not responsible for their content, availability, terms or changes.
11. Limitation of Liability
To the fullest extent allowed by law, Geek Audit is not liable for any indirect, incidental or consequential damages, or for lost profits, revenue or data. Our total liability for any claim related to the Services is limited to the fees you paid us for the specific Service in the three months before the claim.
12. Disclaimer
The Site and its content are provided “as is” for general information. Content on the Site is not legal, financial or tax advice.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Site or Services means you accept the updated Terms.
